This disclosure is made in compliance with Section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECT Act).

2 — Acceptance of Terms

By accessing or using this website, you agree to be bound by these Terms of Service. If you do not agree, you must stop using the website immediately. These terms apply to all visitors, users, and anyone who interacts with Qahwa Coffee Group's services or website.

3 — Services Described

Qahwa Coffee Group provides the following services:

4 — Website Content Disclaimer

All information on this website — including lot descriptions, processing methods, cupping notes, pricing indications, and availability — is provided for informational purposes only and does not constitute a binding offer. Lot availability, pricing, and specifications are subject to change without notice. A binding agreement is formed only when both parties execute a written purchase order or contract.

Qahwa Coffee Group makes no warranty — express or implied — that information on this website is complete, accurate, or current. All product descriptions are provided in good faith based on documentation available at the time of publication.

5 — Pricing, Payment, and Trade Terms

All pricing is quoted individually per transaction. Prices displayed on this website are indicative and do not constitute a fixed offer. Payment terms, delivery terms (FOB/CIF), minimum order quantities, and logistics are defined in each purchase order or trade agreement.

Late payment: Invoices not paid within the agreed period accrue interest at 2% per month (or the maximum rate permitted by law, whichever is lower) from the due date until paid in full. Qahwa Coffee Group reserves the right to suspend further shipments and withhold documentation until all outstanding invoices are settled.

All deposits and advance payments are non-refundable unless otherwise specified in the trade agreement.

6 — Intellectual Property

All content on qahwacoffeegroup.co.za — including text, photographs, design, source code, lot documentation specimens, brand identity, and logos — is the exclusive intellectual property of Qahwa Coffee Group. You may not copy, reproduce, distribute, modify, or create derivative works from any content on this website without prior written permission.

Photographs of coffee lots, certificates, and processing facilities are provided for reference only. Reproduction for commercial purposes is prohibited without written consent.

7 — Limitation of Liability

To the maximum extent permitted by South African law:

8 — Product Quality and Agricultural Disclaimer

Coffee is an agricultural product subject to natural variation. While Qahwa Coffee Group provides cupping scores, processing descriptions, and quality documentation in good faith, these represent assessments at a specific point in time. Qahwa Coffee Group does not guarantee that bulk lots will identically match sample characteristics. Quality assessments are performed using industry-standard protocols but are inherently subjective.

All claims regarding product quality must be made in writing within 14 calendar days of delivery, accompanied by an independent cupping assessment from a certified Q-grader.

9 — Indemnification

You agree to indemnify, defend, and hold harmless Qahwa Coffee Group, its principal, employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

10 — Third-Party Services

This website uses third-party services including Google Analytics, Hostinger (hosting), and WhatsApp (messaging). Your interaction with these services is governed by their respective terms and privacy policies. Qahwa Coffee Group is not responsible for the availability, performance, or privacy practices of any third-party service.

11 — Force Majeure

Qahwa Coffee Group shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, pandemic, government action, export/import restrictions, sanctions, crop failure, drought, frost, plant disease, port closure, shipping delays, power failure, internet disruption, or any other force majeure event.

12 — Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa, including but not limited to the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), the Protection of Personal Information Act 4 of 2013 (POPIA), and the Consumer Protection Act 68 of 2008 (CPA).

Dispute resolution:

  1. Negotiation — the parties shall attempt to resolve any dispute through good-faith negotiation within 14 days of written notice
  2. Mediation — if negotiation fails, the dispute shall be submitted to mediation. Mediation costs are shared equally.
  3. Litigation — if mediation fails, either party may submit the dispute to the courts of the Republic of South Africa, specifically the Magistrate's Court or High Court with jurisdiction in Gauteng

Legal costs: The substantially prevailing party shall be entitled to recover its reasonable legal costs and attorney fees from the other party.

13 — Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
